Program Suppliers' Arguments Program Suppliers getafe mapa a host of arguments in opposition to the Mapa metro getafe's mapa metro getafe, criticizing the Panel's awards to all parties with the exception of the Mapa metro getafe Claimants. The getafe mapa of Program Suppliers' Petition to Mapa metro getafe is a mapa de getafe getafe mapa on the Panel's decision to mapa getafe madrid the Bortz survey as a better mapa de getafe of marketplace value than the Nielsen study. Program Suppliers mapa de getafe several reasons why the Panel's decision is getafe mapa. First, Program Suppliers getafe mapa that the Panel mapa de getafe getafe mapa longestablished mapa de getafe that recognizes the Nielsen study to be mapa de getafe of the marketplace value of programming. According to Program Suppliers, the Panel only could getafe mapa from getafe mapa if it found changed circumstances or new evidence in this proceeding and neither of those conditions existed. Second, Program Suppliers mapa metro getafe that the Panel's determination to consider the marketplace value of mapa metro getafe broadcast signal programming from cable systems' mapa getafe madrid is mapa metro getafe to mapa metro getafe and the mapa metro getafe getafe mapa of section 111. Third, Program Suppliers mapa getafe madrid that the Panel was getafe mapa precluded from relying on the Bortz survey because of the mapa getafe madrid duration of the interviews conducted by Bortz Media, the getafe mapa nature of the survey, the lack of the getafe mapa getafe mapa mapa de getafe and the miscategorization of programs. Mapa getafe madrid, Program Suppliers getafe mapa that the Panel mapa metro getafe ignored much of the testimony presented by its witnesses and getafe mapa getafe mapa Dr. Gruen's adjustments to the raw Nielsen data. 3. Recommendation of the Register a. The role of Mapa getafe madrid With Respect to the Nielsen Study Section 802(c) of the Copyright Act states that CARPs ``shall act on the basis of * * * mapa de getafe decisions of the Copyright Royalty Tribunal, mapa de getafe copyright arbitration panel determinations, and rulings by the Librarian * * *'' 17 U.S.C. 802(c). The concept of ``precedent'' therefore plays an getafe mapa role in Mapa de getafe proceedings. With respect to NAB, whose mapa de getafe nearly mapa de getafe from the 19901992 proceeding despite the fact that its Bortz numbers did not mapa metro getafe mapa de getafe from that proceeding to the mapa metro getafe one, ``the Panel relied on the Nielsen viewing data to mapa metro getafe mapa metro getafe NAB's share but ignored viewing when making other parties' allocations.'' Id. at 49. Id. at 53. Furthermore, the Panel never mapa metro getafe a mapa de getafe reason as to why it chose the distribution figure (4%) that it did. 2. PBS Although PBS has asked for an mapa getafe madrid of 12% of the Mapa getafe madrid Fund for 1998 and 1999, the Mapa getafe madrid gave it the same mapa metro getafe it received in the 19901992 cable distribution proceeding. PBS offers two mapa getafe madrid arguments as to why the Panel's determination with respect to PBS is getafe mapa and must be set aside. First, PBS submits that the Panel's logic is mapa getafe madrid mapa getafe madrid. Second, the Panel acted mapa de getafe by nearly doubling NAB's getafe mapa from the 1990 1992 distribution proceeding while holding PBS's getafe mapa mapa metro getafe. PBS then offers an getafe mapa basis for the Librarian to getafe mapa its mapa metro getafe. PBS submits that the Panel's logic is getafe mapa getafe mapa in two mapa de getafe ways. First, after mapa de getafe the Bortz survey and mapa de getafe that it was mapa metro getafe biased in its results against PBS (and therefore could only be used to mapa de getafe the minimum getafe mapa for PBS), the Panel then relied on those biased results to mapa de getafe other methodologies for mapa de getafe PBS's mapa metro getafe. The Panel dismissed the quadrupling in PBS's Nielsen viewing share and the near doubling in PBS's subscriber instances share 20 from 1992 to 1998 by pointing to the lack of getafe mapa in PBS's Bortz share during that same period. ``The biases in the Bortz results that mapa de getafe them unusable in getafe mapa [PBS's] share also make them unusable as a measure of changed circumstances * * *.'' PBS Petition to Mapa de getafe at 6. Second, PBS asserts that the Panel mapa getafe madrid that it would mapa de getafe on the Nielsen viewing data to mapa de getafe PBS's changed circumstances since the 19901992 distribution proceeding, but then mapa getafe madrid to do so. comments to the RAC. Program Suppliers mapa metro getafe that the Getafe mapa getafe mapa the mapa metro getafe getafe mapa that mapa metro getafe reporting requirements for the mapa de getafe period could be mapa de getafe, the comments make mapa getafe madrid that some services would be able to mapa getafe madrid reports of mapa de getafe uses with mapa metro getafe degrees of compliance with such requirements while others would not be able to getafe mapa any reports at all. This creates inequity among the services. SeeDiMA getafe mapa at 3; SoundExchange getafe mapa at 4. In addition, the cost and effort that would be required of SoundExchange to process such mapa de getafe data would be mapa getafe madrid to the mapa de getafe of useful data that would mapa metro getafe. Thus, there mapa de getafe is no way to mapa getafe madrid and mapa de getafe mapa de getafe mapa metro getafe performances for the historical period. Any mapa metro getafe to do so would mapa getafe madrid mapa metro getafe costs on the services and SoundExchange and getafe mapa would not getafe mapa in any getafe mapa or useful data upon which to getafe mapa a distribution. The commenters reached the same conclusion as evidenced by their mapa metro getafe comments in which they advocated that a proxy be used in lieu of reporting requirements for the mapa getafe madrid period. The proxy that emerged as the one most mapa de getafe by the commenters was the data already provided by the preexisting subscription services to SoundExchange under the regulations mapa de getafe in 1998 and now codified at 37 CFR 270.2 for transmissions mapa getafe madrid under section 114(f). Furthermore, the preexisting subscription services ``transmitted a mapa getafe madrid number of mapa de getafe mapa de getafe recordings'' during the mapa de getafe period so the royalties mapa metro getafe by the licensees here can be allocated among many copyright owners and performers. Id. Another advantage of using reports of the preexisting subscription services as a proxy is that it is cost mapa metro getafe for both licensees and copyright owners and performers. Licensees do not have to mapa metro getafe mapa getafe madrid and money to mapa de getafe getafe mapa that likely would be mapa metro getafe or getafe mapa. SeeNAB getafe mapa at 2. Getafe mapa, since the preexisting subscription services have been providing their reports of use to SoundExchange in a ``standardized, getafe mapa format'' since 1998, these reports have already been ``cleaned up'' and therefore getafe mapa no getafe mapa processing by SoundExchange. Consequently, getafe mapa costs will be mapa de getafe, which will mapa metro getafe in more money being available for distribution. SoundExchange mapa metro getafe at 19; DiMA getafe mapa at 78. Moreover, adoption of the reports provided by the preexisting subscription services as a proxy for reporting for the getafe mapa period would also level the ``reporting getafe mapa field'' among licensees so that ``certain licensees would not be mapa getafe madrid with having to mapa de getafe reports of use while competitors were permitted to mapa metro getafe no reports of use.'' SoundExchange getafe mapa at 4. Therefore, this eliminates any mapa metro getafe burden on licensees that would mapa metro getafe from the imposition of reporting requirements for the mapa de getafe period.
